Генеза правової охорони анімаційних аудіовізуальних творів

Анотація
У статті досліджено історію становлення правової охорони анімаційних аудіовізуальних творів у процесі розвитку технологій їх виробництва. На прикладі еволюції законодавства окремих держав світу та положень Бернської конвенції про охорону літературних і художніх творів розкрито теоретичні підходи до правової охорони анімаційних аудіовізуальних творів та їх генезу. Встановлено, що причина множинності використання термінів «кінематографічний твір», «фільм», «рухоме зображення», «аудіовізуальний твір» у сучасному законодавстві є наслідком неоднозначності підходів до правової охорони такого виду творів, що склалась історично.
