Судовий захист торговельних марок в Італії

Анотація
У статті проаналізовано систему судового захисту прав на торговельні марки в Італії. Основна увага зосереджена на судових процедурах, передбачених цивільним процесуальним законодавством держави. Розгляд справ, пов’язаних із захистом прав на торговельні марки, а також справ щодо недобросовісної конкуренції здійснюється спеціалізованими палатами інтелектуальної власності в загальних судах, що розглядають цивільні та кримінальні справи (першої та другої інстанції). Розкрито підстави пред’явлення позовів, проаналізовано види судових рішень та підходи до визначення санкцій.
