Транскордонні виклики імплементації державами-членами статей 15 та 17 Директиви (ЄС) 2019/790 про авторське право і суміжні права на єдиному цифровому ринку

Анотація
У статті проаналізовано імплементацію статей 15 і 17 Директиви (ЄС) 2019/790 у праві держав-членів ЄС. Висвітлено транскордонні виклики, пов’язані з правами видавців преси та відповідальністю онлайн-платформ. Окреслено правову фрагментацію, зумовлену відмінностями національних моделей реалізації зазначених положень, проаналізовано її наслідки для функціонування Єдиного цифрового ринку. Розглянуто явище «gold-plating» та його вплив на цілісність правового простору ЄС. Обгрунтовано, що розбіжності в імплементації породжують правову невизначеність і ризики для бізнесу в межах Єдиного цифрового ринку.
