Administrative and legal liability for violations of environmental requirements in the cement industry

Abstract
The article studies administrative liability for infringements of environmental requirements in the cement industry of Ukraine as a tool for ensuring environmental safety. The key environmental risks of cement production are revealed, and their connection with the subject of administrative proceedings is shown. An analysis of the regulatory framework establishing the responsibilities of cement plant operators in the field of air protection, water use, and waste management, as well as modern regulatory transformations, was carried out. The composition of the main administrative torts in the field of environmental protection has been determined, and the sanction mechanisms of the Code of Administrative Offenses have been systematized (violation of permit conditions, waste management, land pollution, monitoring, reporting and verification requirements rules for greenhouse gases). The competence of state environmental control bodies and typical problems of law enforcement (proving, recording of excesses, implementation of regulations, preventive effect of fines) are addressed. A conclusion was formulated on the need to strengthen compliance at enterprises through environmental audits, modernization of treatment equipment, proper reporting, and timely receipt of an integrated permit.
