Secret, employee inventions and trade secrets: the relationship of legal sub-institutions

Abstract
The article presents the result of a comparison of the legal sub-institutions of secret inventions, employee inventions, and commercial secrets according to the current state of domestic legal regulation. The purpose of the study was to analyze the ratio of the sub-institutes of secret inventions, employee inventions, and commercial secrets in the national legislation, to identify the common and different, and to develop appropriate recommendations for improving its effectiveness. The study and comparison of the specified sub-institutions of law was carried out by studying the regulatory and legal framework in this area, in particular legislation in the field of intellectual property, information, labor, and competitive legal relations. The advantages and disadvantages of secret, employee inventions, and commercial secrets as mechanisms of protection of various objects of patent law are shown. In the course of the analysis, it was concluded that the researched legal sub-institutes are interdisciplinary in nature. In turn, employees and secret inventions are sub-institutes of the institute of inventions. In the conditions of a market economy, obtaining an advantage in the form of new technologies can become decisive and allow you to gain an advantage over competitors; it is choosing the right ways to protect intellectual property rights that allows you to avoid problems in the future. Conclude that the Ukrainian legal system needs legislative improvement and modernization in order to bring it into line with the requirements of the time, especially considering the existence of already developed protection mechanisms in industrially developed states and international organizations. Specific ways of improvement of the specified sub-institutes are proposed. For example, the implementation of the EU Directives related to commercial secrets is urgent, which will improve the mechanisms of protection of the specified sub-institution of law. In addition, it is appropriate to impose criminal liability for the improper use of the studied legal sub-institutions. The research has further prospects, as it is expedient to carry out a further comprehensive analysis and comparison of the specified legal sub-institutions with corresponding similar ones in industrially developed countries.
