Search for approaches to the use of artificial intelligence in patent examination

Abstract
Inventions are the key foundation of innovation. When a new technology is introduced to the market, society benefits – both directly, as it can allow us to do things that were previously impossible, and indirectly, in terms of the economic opportunities (business development and employment) that can result from it. Currently, the only way to obtain proper legal protection for an invention is to register a patent for the invention. The delay in obtaining a patent has a significant negative impact on the business and innovation processes of any country. In view of the increasing number of patent applications both in Ukraine and globally, it is important to study methods of optimizing the processes of patent examination. The article is focused on addressing the problem of a steadily increasing number of patent applications by using artificial intelligence technologies in the process of patent application examination. It examines the relevance, methods, and results of using artificial intelligence technologies in economically developed countries. Particular attention was paid to the cooperation between the National Institute of Industrial Property of Brazil and the American Chemical Society.
On September 4, 2020, these organizations signed a Technical Cooperation Agreement aimed at testing and optimizing patent examination processes using artificial intelligence technologies. This cooperation demonstrated convincingly positive results in optimizing patent examination processes using artificial intelligence technologies. The article also analyzes the content of Ukraine’s «Rules for Examination of Applications for Invention and Utility Model Applications» and identifies the stages at which the use of artificial intelligence technologies is possible and appropriate, given the importance of optimizing processes and speeding up the examination of patent applications. As a result of the study, we believe it is necessary to start working on the development and implementation of AI technologies in the patent application examination process by the national patent office. This will help speed up the examination of patent applications and, accordingly, stimulate innovation in Ukraine.
