Artificial intelligence and intellectual property: conceptual approaches of the WIPO and Ukraine

Abstract
The article is focused on the conceptual regulation of the development and interaction of artificial intelligence technologies and intellectual property. The development and use of artificial intelligence technologies are gaining momentum and becoming ubiquitous, and the field of intellectual property is no exception. The aim of intellectual property legislation, in particular, is to effectively stimulate innovation and creativity and at the same time, to protect the public interests. Therefore, it is essential to analyze the current legal regulation at the conceptual level, as well as to provide recommendations that will facilitate the development and implementation of effective legal regulation in this area. The following conceptual documents were subject to research and analysis: the Revised Issues Paper on Intellectual Property Policy and Artificial Intelligence and the Concept of Artificial Intelligence Development in Ukraine. This study analyzed the content, structural elements, and format of information in both conceptual documents. It was also concluded that the Revised Issues Paper on Intellectual Property Policy and Artificial Intelligence covers a wide range of topical issues in this area; hence, it is a fundamental document that can be used as a basis for further development of a specific regulatory framework. After a detailed analysis of the Concept for the Development of Artificial Intelligence in Ukraine, the author has identified numerous drawbacks in the structure and provisions, potentially slowing down the process of developing an effective legal and regulatory framework in this area. The author suggests restructuring the Concept of Artificial Intelligence Development in Ukraine and supplementing it with a separate section or a number of provisions on the regulatory and legal regulation of social relations arising in the field of interaction between AI and IP. The author also points out and justifies the importance of using the provisions of the Revised Issues Paper on Intellectual Property Policy and Artificial Intelligence to improve the provisions of the Ukrainian Concept of the Development of Artificial Intelligence in Ukraine.
