Codification of legislation in the field of copyright and related rights: EU Member States experience and proposals for Ukraine

Abstract
The article highlights the level of systematization of Ukrainian legislation on copyright and related rights and the experience of the EU Member States in codifying legislation in this area. In the article, the approaches to the interpretation of the essence of codification of legislation in Ukrainian and European doctrine are presented, and the experience of the EU Member States in the development of legislation in the field of copyright and related rights is analyzed.

Codification as a form of systematization of legislation has somewhat different interpretations in Ukraine and EU member states, but leads to the same result in the form of the adoption of one act that exhaustively regulates a certain area of public relations. EU Member States are characterized by the existence of a codified act that serves as a single legal source of copyright and related rights. Instead, Ukrainian legislation in this area is not systematized. Firstly, certain provisions of the Law of Ukraine “On Copyright and Related Rights” are duplicated in the Civil Code, which has effectively created a two-level legal regulation of the same social relations. Secondly, certain provisions on the specifics of copyright and related rights in certain types of activities are contained in other laws, in particular, “On Theaters and Theater Business”, “On Architectural Activities”, and “On Cinematography”, which led to a partial fragmentation of legal regulation of the same social relations.

Following the example of the EU Member States, domestic copyright and related rights legislation should be codified in one law, eliminating the repetition of its provisions in the Civil Code and the inclusion of provisions in other laws on the acquisition and exercise of copyright and/or related rights to certain objects. The Civil Code should retain a general provision on the protection of copyright and related rights, which is carried out in accordance with the law, but all aspects of this protection should be specified in one act. Taking into account the European integration aspirations of our country, following the European traditions of codifying legislation will help to improve the quality of legislation and the effectiveness of law enforcement practice.
