Civil Protection of Copyright and Related Rights in the Federal Republic of Germany and Ukraine

Abstract
The article examines copyright and related rights protection in the FRG in accordance with provisions of the Law of September 9, 1965, “On Copyright and Related Rights” with consequent changes and amendments, other legislative acts of such country, as well as includes the comparative analysis of the Law of Ukraine “On Copyright and Related Rights”.

The following provisions of civil legal protection are considered in the article: warning of the infringer before bringing a court action; providing information and documentation; responsibility of the business owner; compensation; provision of claims for damages; statute of limitations; publication of a court decision, judicial procedure, jurisdiction, specialized copyright and related rights courts. The authors considered the features of dispute settlement by application of the “Notification” procedure.

The article analyses court cases heard in Germany. In particular, the author analyses court decisions that clarify approaches to determining the amount of damages for copyright infringement.

The peculiarities of the jurisdiction of civil law protection of copyright and (or) related rights in Germany and Ukraine are determined.

The author analyses the norms of the German and Ukrainian laws on the conditions for payment of compensation by the infringer instead of damages. The difference in the application of compensation in accordance with the norms of the laws is highlighted.

Based on the analysis of the laws of Germany and Ukraine, the authors note that copyright and related rights are protected in accordance with the requirements of the European Union. However, the norms of German law have certain peculiarities, which are highlighted in the article.

The author analyses the rules established by the German “Act on the Liability of Online Content Exchange Service Providers” for Copyright Infringement regarding the liability of digital platforms for the distribution of illegal content uploaded by their users.

The authors make proposals to take into account certain norms of German copyright and related rights legislation when improving the system of copyright and related rights protection in Ukraine.
