Blockchain technologies in copyright protection and management: foreignexperience and the situation in Ukraine

Abstract
The article is devoted to determining the role of blockchain technology in the protection and management of copyright in the world and in Ukraine. The article defines the concept of blockchain and its components. The article fully supports the position of O. Baranov regarding the legal solution to the application of blockchain technologies, thanks to the definition of the legal status of the blockchain network, its registry, transaction records, legal requirements for their form and content, blockchain network registry jurisdictions, and others. This will make it possible in the future, for the field of copyright to create a Ukrainian national register with the following parameters: authors, rights holders, names of objects, time, and date of creation of objects, cost of remuneration; transactions regarding objects, etc. In the future, it is possible to create unified standards for blockchain.
The article examines, among others, the most famous systems based on blockchain technology that record and protect copyright: Ascribe, Binded, Credits, Proof of Existence, and WIPO Connect. In accordance with copyright management, the article discusses the concept of a smart contract and components of smart contracts. The author fully agrees with the proposal of Zadobruk D. regarding the existence of smart contracts within the legal framework, the legislative consolidation of the concept of «smart contract», the definition of the order of its regulation and conclusion because this will help the owners of smart contracts to carry out transactions for the sale of objects for a fee, and the procedure for regulating and entering into smart contracts will provide control to the owners over the use of their copyright objects, countermeasures against violators. The procedure for concluding smart contracts will simplify their execution and in the future will lead to the development of a single form of smart contract. As a conclusion, it is proposed to: create a single register of copyright in Ukraine; establish the concept of blockchain in the legislation of Ukraine; develop an agreed set of blockchain standards and enshrine them in legislation; implement the term «smart contract» into the legislation of Ukraine, and establish the procedure for its conclusion and regulation.
