Theory and practice of codification of legislation in the field of industrial property: comparative legal aspect

Abstract
The further period on the way to Ukraine’s accession to the EU is closely related to the sphere of intellectual property, since it is precisely related to ensuring the stabilization of Ukraine’s economic development, national security, and defense capability.

Increasing the standards of IP protection is an integral part of the development of the world’s leading economies, oriented towards innovative technologies, and the direction of international cooperation.

One of the conditions for the effective functioning of the national system of legal protection of intellectual property rights is the presence of high-quality legislation. The way to its creation is the implementation of EU legislation into Ukrainian legislation, its incorporation, and codification.

The aim and objectives of the study are to analyze the results of the codification of legislation in the field of industrial property of foreign countries, to identify general and special approaches to determining the content and structure of codification acts, and on this basis to make an assessment and formulate proposals regarding the possibility or impossibility of borrowing this experience when developing a concept and project codification act in the field of industrial property in Ukraine.

The conducted analysis shows that the industrial property codes of Italy, Spain, and Portugal represent unified legal acts, and although they all contain general provisions, they are not codes in the sense of a codified act in Ukraine.

The complex nature of the analyzed acts may be convenient to use, but leads to varying degrees of duplication of norms with special legislation (procedural, criminal, and administrative). Borrowing such an approach to the codification of legislation in the field of industrial property is considered unsuitable for Ukraine. In addition, the very procedure and reflection of the result of the harmonization of Ukrainian legislation with EU legislation has a significant difference in comparison, for example, with the legislation of, say, Portugal.

The analyzed regulatory acts contain a number of provisions that could be usefully used in Ukraine, especially in the post-war period, would enrich the content of Ukrainian legislation, and provide additional guarantees of protection to the authors of industrial
property objects.
