Challenges in proving the extent of damages and compensation in trademark infringement cases

Abstract
The article examines the practical aspects of proving the amount of damages caused by the infringement of trademark rights, as well as the amount of compensation sought in connection with such infringement. The key methods for calculating damages caused by the infringement of trademark rights are identified, and the principal legal positions of the Supreme Court of Ukraine on this issue are outlined. The study analyzes recent judicial practice concerning the recovery of actual damages and lost profits in cases related to the protection of trademark rights. It also reviews the regulatory framework governing the determination of damages under the legislation of the European Union and the United States. Based on the results of the research, the article identifies the main shortcomings of Ukrainian law-enforcement practice in the sphere of proving the amount of damages, which reduce the effectiveness of judicial protection of rights. The paper further proposes potential avenues for improving national legislation with regard to determining and proving the amount of compensation to be awarded in cases where infringement of trademark rights is established.
