Originality of the creation: legislative innovations and prospects for its implementation

Abstract
In the context of the ongoing processes of implementation of the norms of EU law on copyright and related rights to the national legislation on copyright and related rights, the article raises the problem of different scientific approaches in the EU and in Ukraine regarding the perception of the concept of originality of a work. Therefore, the article is devoted to the assessment of legislative innovations regarding the determination of the originality of creation in clause 35 of Art. 1 of the Law “On Copyright and Related Rights”, providing a characterization of their value for the scientific and law enforcement spheres. The main provisions of the concept of originality under EU law regarding copyright and related rights were determined, and an analysis of scientific views and provisions regarding the originality of creation in national copyright law was carried out. On the basis of the conducted analysis, differences in the understanding of the concept of originality in the EU law regarding copyright and related rights and in national copyright law have been determined. A comparative analysis of the doctrine, legislation, and judicial practice of the EU regarding the issue of the distribution of the burden of proving the originality in court and the relevant sources of the national system of copyright protection regarding the judicial establishment of the creative nature of the author’s work in creating creation is provided. Based on the relationship between the concepts of “originality”, “creative character”, “creation”, as well as the results of the comparative analysis, it is noted that there is a “presumption of originality” of literary and artistic works (within the meaning of Article 2 of the Berne Convention) in the national copyright protection system, which consists in the assumption that a creation on which an author is indicated, and this author goes to court to protect his violated, unrecognized, contested copyright, is considered original until proven otherwise. It is justified that the originality of the creation is enshrined in clause 35 of Art. 1 of the Law “On Copyright and Related Rights” as a criterion for the provision of legal protection. The significance of the legislative consolidation of the originality of creation in the law-making and law-enforcing spheres is outlined.
