Legal regulation of the assessment of damages from the violation of intellectual property rights in Ukraine, the EU, and the USA

Abstract
The assessment of intellectual property rights is carried out for the purpose of determining and calculating damages caused as a result of their violation, which belongs to the competence of judicial experts and appraisers in the field of intellectual property. However, the issue of the methodical support of such an assessment remains unsolved since today in Ukraine, there is no single methodical regulation of the assessment of damages caused by the improper use of intellectual property rights objects.

The purpose of this article is to identify problem areas of Ukrainian legislation in the field of assessing damage from violation of intellectual property rights based on the study of legislation, methodological support, and practical experience in the jurisdictions of the EU, and the USA. The study showed that the assessment of damage for violation of intellectual property rights in Ukraine, the EU, and the USA has common features, such as compensation for lost income and recovery of income received by the offender, but differs in details. Compared to Ukraine, the EU and the USA have more developed legal mechanisms that provide more effective protection. The practical implementation of the assessment of damage from violation of intellectual property rights in Ukraine is complicated by the need for evidence, insufficient judicial or economic expertise, as well as the lack of clear assessment criteria, and needs to be improved.

Economic expertise and assessment of damage from violation of intellectual property rights in Ukraine is based on general approaches determined by domestic assessment practice and legislative norms, but does not have specialized methodological support. Such assessments are often made in conditions of an acute shortage of reliable market data, and expert assessments are frequently based on empirical data. It is concluded that in order to effectively protect intellectual property rights and improve the accuracy of economic assessment, it is necessary to develop a modern methodology adapted to the digital economy and clearer evaluation standards, which would reduce subjectivity and facilitate the protection of copyright holders.
