Abstract
The article examines the peculiarities of the legal status of representatives in the field of intellectual property – patent attorneys, analyzes the conditions for acquiring this status under the legislation of Ukraine and in the laws of certain foreign countries, and defines the requirements for the competencies of persons who intend to become patent attorneys. In the context of harmonizing national legislation with EU law, the shortcomings of legal regulation in this area of social relations are identified. Based on the analysis and taking into account foreign experience, conclusions and proposals are formulated aimed at improving the legislative support for the activities of intermediaries in intellectual property relations in the national legal system of intellectual property protection. The analysis of the requirements for candidates for patent attorneys in the US and EU law confirms the need for technical education for candidates who will specialize in patents. Practical work experience in the field of technical sciences may only be an additional requirement for a candidate for patent attorney, which, however, should not be an alternative to technical education.
