Collective trade marks: a comparative legal study of the legislation of the European Union and Ukraine

Abstract
The article examines the legal regulation of collective trade marks under the legislation of the European Union and Ukraine. The subject matter of the study encompasses the concept, functions, eligible entities, registration procedure, and specific features of the use of such trade marks, as well as the extent to which Ukrainian legislation has been approximated to EU law. The provisions of the Paris Convention, EU trade mark legislation, the Law of Ukraine “On Protection of Rights to Marks for Goods and Services”, subordinate legislation, and draft legislative amendments are analysed. Particular attention is paid to the rules governing the use of collective trade marks, compliance control, and specific grounds for refusal of registration and termination of legal protection. Based on the analysis conducted, the article concludes that collective trade marks should be regarded not only as an instrument for distinguishing goods and services, but also as an effective mechanism for business development, product promotion, and fostering consumer confidence in products. In this regard, the article also proposes drawing on the experience of the European Union.
