On improving the formation and operations of the Appeals Chamber of the National Intellectual Property Authority in the context of intellectual property legislation reform

Abstract
The article is devoted to issues of administrative protection of rights to objects of industrial property. In particular, the issues of the formation and principles of activity of specially created bodies that implement the administrative protection procedure in the relevant administrative proceedings are investigated. The norms of Ukrainian and EU legislation contain requirements regarding the composition, principles, and subject matter of the activity of such bodies. The study shows the inconsistency of the provisions of the Regulations of the National Intellectual Property Authority (NIPA) Appeals Chamber with the generally recognized principles of the construction of appellate bodies that consider appeals against decisions of national IP offices and first-instance departments of the European Patent Office. The practice of the European Patent Office shows the significant role of the Technical Boards of Appeal in considering appeals on merits. The article draws attention to the fact that the list of principles of the NIPA Appeals Chamber, established in the Regulations of the NIPA Appeals Chamber, is not provided with an appropriate mechanism for their implementation; ways of solving the identified problems are proposed.
