Insurance in the field of intellectual property as an element of the mechanism of protection of these rights: a general overview

Abstract
The renewal of insurance legislation, which coincided with revolutionary changes in digital technologies, influenced the emergence of new opportunities for the creation and use of intellectual property rights objects and increased the risks of violation of these rights. Given the specifics of insurance, insurance cases, the subject and objects of insurance, as well as the legal nature of intellectual property rights, the article identifies possible options for insurance in the field of intellectual property law. It is established that insurance of intellectual property rights objects, as such, is not provided for in Ukraine and the EU Member States. Insurance is possible for material and digital objects in which objects of intellectual property rights are embodied and which are the external form of their expression, that is, they are objects of the material world and are in the legal regime of things. However, such insurance does not contribute to a clear delineation of property and intellectual property rights objects, as well as intellectual property rights and property rights. At the same time, property rights to one or another object of intellectual property law may be the object of insurance.
