Such a state creates in practice a vagueness for the subjects of the marked legal relationships in their rights and duties, negatively influences the realization of interests of these subjects, stability of contractual obligations, and creates the threat of violation of their rights. Harmful consequences are analyzed for the realization of innovative activity of co-ownership property rights on a service invention by an employer and employee.<\/p>\n\n\n\n For the decision of this problem offered approach the optimal variant of concordance of interests of subjects of official invention, after what legal subject on the receipt of patent\/of certificate, and as a result, by the subject of property rights, the subject of menage – employer must near-term confess, and the proper explaining and stimulant providing must get a to the creator-worker as a material reward. <\/strong>In the article it will be that as creators of results of intellectual activity physical persons come forward exceptionally, then plenitude of actions of subjects of menage in relation to realization of rights on the objects of intellectual property depends on the proper settlement of order of acquisition and distribution of rights on the marked objects, in fact considerable part of results of intellectual property in the field of a menage created exactly by workers. Interests of subjects of menage are certain in the field of acquisition and realization of rights on the objects of intellectual property, that is created during implementation of labour duties, as interests, that consist in the unimpeded use of objects in own economic activity with the aim of strengthening of its competitiveness, introduction in activity of innovative constituent, commercialization of official objects of intellectual property.<\/p>\n\n\n\n
