The article examines the approaches to the interpretation of the principle of legal certainty in the case law of the European Court of Human Rights, the European Court of Justice, and the Constitutional Court of Ukraine.<\/p>\n\n\n\n<p>The quality of legislation plays a key role in the ability of the law to act as a proper regulator of relations, meeting the needs of society and the state. A high-quality legal rule has clear wording that makes the content of the rule unambiguous and allows predicting very specific consequences of its application, which serves to ensure the principle of legal certainty. Instead, a rule with uncertain content is unpredictable as it can be interpreted arbitrarily at the discretion of the person concerned, which leads to abuse, the formation of different approaches in similar cases in legal practice, and generally poses a threat to legal security in the state.<\/p>\n\n\n\n<p>However, Ukraine does not have established requirements that must be met when drafting laws. The absence of criteria to guide drafters negatively affects the quality of legislation and its certainty. This problem is illustrated by the example of the Law of Ukraine &#8220;On Copyright and Related Rights&#8221;. Several examples of provisions whose content is unclear, which makes them difficult to interpret and may lead to abuse or unintentional violations, are given. This applies, in particular, to the concept of broadcasting and the program of the broadcasting organization, which are defined in the Law almost identically, while the content of the concept of broadcasting does not correspond to its interpretation in the specialized law, the Law of Ukraine &#8220;On Media&#8221;. It was found that the main elements of the freedom of panorama rule are not clearly stated, which hinders the understanding of the limits of permissible user behavior within this rule. Also, I criticize the use of the terms commercial purpose, commercial benefit, and independent economic value in the Law, which should be replaced by one unified term. These examples confirm the urgency of the need to establish clear requirements for the content of draft laws, as the intensity of lawmaking processes in Ukraine is not decreasing, but the quality of
