Based on the analysis of the new Law of Ukraine &#8220;On Copyright and Related Rights&#8221;, a conclusion is formulated about the inconsistency of the provisions provided for<br>in Art. 1, which contains the definition of a work of architecture, clause 11, part 1, art. 6, and Part 1 of Art. 9 of this Law. The result of this was the identification of the form of expression of works of architecture with their varieties. <\/p>\n\n\n\n<p>Based on the analysis of special legislation in the field of architecture and building regulations, it is proposed to distinguish two groups of copyright objects in the field of architectural activity: these are houses, structures, gardens, parks, etc., and project documentation (plans, sketches, drawings, etc.), based on which the first group of objects is created.<\/p>\n\n\n\n<p>The author&#8217;s definition of a work of architecture is proposed as the result of the author&#8217;s intellectual creative activity, which reflects his creative decisions made during the creation of buildings and structures, works of garden and park art, and landscape formations. At the same time, it is proposed to leave &#8220;drawings, sketches, models, etc.&#8221; as independent objects of legal protection by copyright, as they are specified in Clause 15, Part 1 of Art. 6 of the Law of Ukraine, No. 2811-IX. <\/p>\n\n\n\n<p>Special attention is paid to the legal nature of the project of architectural objects: its connection with the architect is revealed, its functional purpose and place in the process of creating an architectural object are determined, and its structure.<\/p>\n\n\n\n<p>Particular attention is paid to the disclosure of the meaning of such a criterion of protection ability of works, including works of architecture, such as originality.
