It is demonstrated that one of the important features of expert examination in the field of intellectual property, compared to other types of expertise, is that it includes specialized knowledge in the field of intellectual property law among the expert&#8217;s specialized knowledge.<\/p>\n\n\n\n<p>The article provides a thorough analysis of the content and specific characteristics of the expert&#8217;s specialized knowledge in the field of intellectual property. A system of rules for application legal knowledge during expert examination in the field of intellectual property is formulated, namely: not providing legal qualification to disputed legal relations; not determining the procedural outcome of the case on its merits; not explaining the specifics of the content and application of specific legal norms; not exceeding the expert&#8217;s legally prescribed competence; not establishing the extent and nature of liability.<\/p>\n\n\n\n<p>The author concludes that, based on the analysis and study of the content of legal acts, the expert in the field of intellectual property establishes certain circumstances relevant to the case and reflects this evidentiary information in the expert opinion.<\/p>\n\n\n\n<p>The boundaries of the expert&#8217;s competence in the field of intellectual property during application legal knowledge are examined, and a system of its basic defining elements is formed, including: the rights and obligations of the expert; the expert&#8217;s liability; the specific direction of the expert&#8217;s activity; the subject of expertise; the peculiarities of the investigated object of intellectual property; specialized knowledge applicable during the examination of a specific object of intellectual property; rules for application specialized legal knowledge; compliance with the procedure for exercising the right to expert initiative.<\/p>\n\n\n\n<p>Emphasis is placed on the impossibility of duplicating the court&#8217;s powers by the expert and the expert&#8217;s powers by the court.
