The author analyzes the legal mechanisms for ensuring access to medicines and the status of their implementation in national legislation. Priority tasks and prospects for reforming intellectual property and pharmaceutical legislation are identified, taking into account the challenges of martial law and European integration commitments, and in order to remove barriers to the timely entry of generic medicines and biosimilars into the market. Intellectual property rights are a valuable asset of companies developing biotechnology products, and proper protection of intellectual property rights provides incentives for research in the pharmaceutical industry. Ukraine is an importer of some biotechnology products, innovative medicines, especially vaccines, which are not produced by the Ukrainian pharmaceutical industry. At the same time, production facilities are well developed and sufficient to provide the domestic market with necessary and high-quality generics and biosimilars. Ukraine is harmonizing its national legislation with EU law.<\/p>\n\n\n\n<p>So far, there is no comprehensive legislative approach to regulating the use of biotechnology methods. Given the transformation of EU legislation in the field of pharmacy and biotechnology, Ukraine is also expected to undergo relevant changes. At the same time, the relevant conceptual and categorical apparatus needs to be defined and unified. In the face of the challenges of Russia&#8217;s military aggression, it is crucial to ensure that innovative medicines capable of treating incurable or poorly treatable diseases are available.
