of the Intellectual Property Scientific Research Institute &nbsp;of the National Academy of Legal Sciences of Ukraine<br>Ukraine<br><a href=\"https:\/\/orcid.org\/0000-0003-2492-231X\">https:\/\/orcid.org\/0000-0003-2492-231X<\/a><\/p>\n\n\n\n<p><\/p>\n\n\n\n<div style=\"height:40px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p><strong>Abstract<br><\/strong>The author identified the negative psychological, economic, and social factors of unfair competition in the digital market. It is noted that competition is a natural part of human behavior and can have both positive and negative effects on a person. Such a system of connections between market entities has relationships that are different in nature, mutual understanding, and tension. The following types of relationships are considered: competition, rivalry, and confrontation. It is determined that economic competition in a fair market is the strongest means of reducing prices and satisfying consumer demand, improving the production and quality of goods and services. Forms of e-business in the digital economy are e-commerce and e-trade, which appear in the implementation of digital activities by digital market entities in compliance with the basic principles of doing business. The negative economic and commercial nature is revealed through the illegal use of other people&#8217;s intellectual products for commercial purposes, violation of the business reputation, goods, or activities of competitors, misleading consumers, and obtaining unfair advantages in competition. E-business models are presented, and the advantages and disadvantages of e-commerce and e-trade are systematized, which deepens the perception of transactions in electronic form and understanding of virtual relationships between business partners and other subjects of the virtual market, which is revealed in detail in e-commerce from the standpoint of features and advantages.<\/p>\n\n\n\n<p>It is considered the economic and commercial nature of unfair competition on intellectual property digital market, which relies on the possibility of finding weaknesses in the technical, technological, and legal imperfections of e-business and e-commerce, which appear in their shortcomings and possible risks for their participants. The author considered the risks of e-commerce participants that arise and are divided into three groups: informational, technological, and commercial. It is determined that one of the ways to overcome unfair competition in the electronic market is to minimize risks during e-business operations, and also, it is given the types of risk minimization during e-commerce.
