The need to obtain consent to use an individual’s name as a character in a work was introduced to prevent the assignment of an individual’s name to a character with whom the individual does not wish to be associated for one reason or another.<\/p>\n\n\n\n As an exception, under Part 2 of Article 296 of the Civil Code of Ukraine, no consent is required for the use of an individual’s name as a character (actor) in literary and other works of a documentary nature.<\/p>\n\n\n\n The exemption of the authors of documentary works from the obligation to obtain consent to use the name of an individual as a character in the work is aimed at ensuring the right of such authors to freely collect and use information, to freedom of speech and dissemination of documented information, as well as the right to freedom of creativity, since documentary works reflect and disseminate not only the author’s creative decisions, but also information expressed in a creative form about circumstances, facts and events that occurred in reality and were documented.<\/p>\n\n\n\n A documentary work is an original intellectual creation of the author that reflects not only the author’s creative decisions, but also circumstances, facts, and events that occurred in reality, and information about such circumstances, facts, and events is contained in documents. A documentary work must contain two elements: 1) reproduction of facts on the basis of documented information and 2) creative decisions of the author.<\/p>\n\n\n\n By virtue of the constitutional principle of freedom of intellectual and creative activity, the author of a documentary work may give his own interpretation of the facts.<\/p>\n\n\n\n The documentary basis of a documentary work, as well as the fact that the work reproduces circumstances, facts, and events based on information contained in relevant documents, must be proven and established in the case of a dispute, taking into account its specific circumstances.
