Issues of legal qualification of the radio broadcasting organization program as an object of related rights<\/strong><\/p>\n\n\n\n

Abstract
<\/strong>The article analyzes legal provisions in the field of copyright and related rights and media regarding the radio broadcasting program. It was established that the formation of a broadcasting program is not creative in nature and is the result of the organizational and technical activities of the broadcaster. Therefore, Ukrainian legislation correctly classifies this object as related rights rather than copyright. At the same time, the updated legislation has several shortcomings that negatively affect the legal qualification of the related rights object of broadcasters.<\/p>\n\n\n\n

The name of the object of protection \u201cprogram of broadcasting organization\u201d does not take into account that an individual who does not have the status of an organization can act as a broadcaster. In view of the changes in the legal regulation of the media, the word \u201corganization\u201d should be removed from the legislative usage in relation to broadcasters. A program that is formed and broadcast by a broadcaster should be defined as a broadcasting program, without reference to an organization.<\/p>\n\n\n\n

The definitions of a broadcasting organization\u2019s program unreasonably ignore a program concept of a broadcaster, which according to the Law of Ukraine \u201cOn Media\u201d is the main basis for the formation of broadcasting organizations’ programs. The program concept is of key importance for the activities of broadcasters, and its violation is recognized as a violation of the requirements of the law and\/or the terms of the license by the audiovisual media. Therefore, the emphasis should be placed on the program concept which should be followed by the broadcaster when forming the broadcasting program.<\/p>\n\n\n\n

Third, the types of audio information in the program of radio broadcasting organization in the Law of Ukraine \u201cOn Media\u201d should be clarified. In terms of the reference to musical works, the Law does not take into account that radio broadcasters can only broadcast phonograms with recordings of musical performances; the term \u201caudio work\u201d is incorrect, as it is not a type of work, but a way of perceiving a work by ear; the types of information that are actually included in the program of radio broadcasting are not mentioned in the Law. These shortcomings should be eliminated so that the legal regulation gets rid of collisions and takes into account the practice of radio broadcasters.<\/p>\n\n\n\n
