Based on the analysis and taking into account foreign experience, conclusions and proposals are formulated to improve the national system of legal regulation of relations in the field of obtaining, using, and disclosing commercial secrets.<\/p>\n\n\n\n<p>In particular, the article notes that in the current legislation of Ukraine, the system of intellectual property rights protection for trade secrets is currently in the stage of formation and development. The norms aimed at ensuring the legal protection of trade secrets are enshrined in regulatory legal acts of various legal force and industry affiliation.<\/p>\n\n\n\n<p>Under EU law, the protection of trade secret rights is ensured by Directive (EU) 2016\/943 of the European Parliament and of the Council of 8 June 2016 on the protection of undisclosed know-how and business information (trade secrets) against their unlawful acquisition, use and disclosure. The article examines the peculiarities of legal protection of trade secrets under Ukrainian and EU law, reviews the practice of law enforcement in the field of trade secret protection in the context of harmonisation of national legislation with EU law.<\/p>\n\n\n\n<p>Ukrainian legislation\u00a0 has a number of shortcomings and contradictions due to the different nature and sectoral affiliation of commercial secrecy rules. In view of the above, a draft Law of Ukraine \u2018On the Protection of Trade Secrets\u2019 was prepared, the provisions of which were presented during a public discussion in 2025.
