It argues that these procedures constitute the \u00abfirst line\u00bb of preventive enforcement. They do not operate in isolation but form part of a multi-layered system in which private autonomy, judicial remedies, and criminal liability mutually reinforce one another. Thus, a patent invalidation proceeding before the IP office does not preclude recourse to the courts, but provides a swift and expert assessment; customs suspension does not finally resolve a dispute, but prevents harm while the right holder substantiates the claim. Together, these elements act as mutual safeguards. The article also underscores that the effectiveness of IP rights ultimately depends on the state\u2019s commitment to ensuring their protection.<\/p>\n\n\n\n<p>The analysis reviews the EU framework for administrative enforcement of IP rights, structured around three layers: customs mechanisms under Regulation (EU) 608\/2013; the horizontal obligations of online intermediaries under Regulation (EU) 2022\/2065; and EUIPO procedures such as oppositions and invalidity actions, in light of the ongoing reform of design law (Regulation (EU) 2024\/2822). In the Ukrainian context, the paper proposes concrete steps for harmonisation with the EU acquis: standardizing AFA and \u00absimplified destruction\u00bb procedures with attention to small consignments and interoperable data flows; developing a transparent notice-and-action system in line with Regulation (EU) 2022\/2065, complete with internal appeals, trusted flaggers, and safeguards against abuse; and strengthening the Appeals Chamber of UANIPIO as a post-grant quality filter, equipped with guarantees of independence, openness, and full digitalization.<\/p>\n\n\n\n<p>The novelty of the approach lies in integrating these three enforcement layers \u2013 customs, platform, and office \u2013 into a single risk-oriented architecture that lowers transaction costs, enhances predictability, and at the same time, preserves full judicial oversight.
