class=\"wp-block-paragraph\"><strong>Abstract<br><\/strong>The article studies the legal regime for the use of a human image as an element of a trademark of medicinal products in Ukraine. It is substantiated that such a trademark combines the private-law dimension of the human right to one\u2019s own image, the function of a trademark as a mean of individualization of goods, and the special public-law regime for the medicinal products circulation. The civil-law conditions for the use of an individual\u2019s image, the grounds for trademarks legal protection, advertising restrictions in the field of medicinal products, requirements for preventing the misleading nature of trademarks, and the approaches of the European Court of Human Rights to the protection of a human image are analysed. It is proved that consent to the creation or one-time use of a human image does not automatically cover its inclusion in a trademark of a medicinal product and subsequent long-term commercial use.
