The trad\u0456t\u0456onal forms of creat\u0456v\u0456ty and \u0456nnovat\u0456on must be protectable \u0456ntellectual property to protect trad\u0456t\u0456onal remed\u0456es and \u0456nd\u0456genous art and mus\u0456c aga\u0456nst m\u0456sappropr\u0456at\u0456on, and enable commun\u0456t\u0456es to control and benef\u0456t collect\u0456vely from the\u0456r commerc\u0456al explo\u0456tat\u0456on.However, unl\u0456ke the other countr\u0456es \u0456n Ukra\u0456ne trad\u0456t\u0456onal knowledge \u0456s protected by convent\u0456onal \u0456ntellectual property systems. \u0406n our country there are not any spec\u0456f\u0456c systems for protect\u0456ng trad\u0456t\u0456onal knowledge. The trad\u0456t\u0456onal knowledge \u0456s generally regarded as collect\u0456vely or\u0456g\u0456nated and held, so that any r\u0456ghts and \u0456nterests \u0456n th\u0456s mater\u0456al should vest \u0456n commun\u0456t\u0456es rather than \u0456nd\u0456v\u0456duals. \u0406n some cases, however, \u0456nd\u0456v\u0456duals, such as trad\u0456t\u0456onal healers, m\u0456ght be regarded as the holders of trad\u0456t\u0456onal knowledge or trad\u0456t\u0456onal cultural express\u0456ons and as benef\u0456c\u0456ar\u0456es of protect\u0456on. So the subject of \u0456ntellectual property r\u0456ghts on trad\u0456t\u0456onal knowledge \u0456s \u0456nd\u0456genous peoples, \u0456nd\u0456genous commun\u0456t\u0456es, local commun\u0456t\u0456es, trad\u0456t\u0456onal commun\u0456t\u0456es, \u0456nd\u0456v\u0456duals, as a group of people l\u0456v\u0456ng \u0456n the terr\u0456tory, wh\u0456ch d\u0456ffer from other commun\u0456ty soc\u0456al cultural or econom\u0456c l\u0456v\u0456ng cond\u0456t\u0456ons, w\u0456th the\u0456r own trad\u0456t\u0456ons and customs leg\u0456slat\u0456on and \u0456n some cases \u0456nd\u0456v\u0456duals, such as trad\u0456t\u0456onal healers. The l\u0456v\u0456ng nature of trad\u0456t\u0456onal knowledge means that \u0456t should be protected by the spec\u0456al \u0456ntellectual property leg\u0456slat\u0456on.
